Terms of Service

Ownership and Services. United Way of the Alberta Capital Region (“United Way”) operates the Give for Good Platform (the “Platform”), a web-based service facilitating the posting and finding of goods and services, in partnership with registered social sector and not-for-profit agency partners designed to support and improve the lives of individuals, communities, and families (“Agency Partners”), with a focus on supporting those in financial need. The services provided by United Way through this Platform include hosting, maintaining, and administering the Platform.

Your Account. In order to access and use the Platform, you are required to register and set up an account with an email address and a password (your “Account”). You are solely responsible for all activities that occur under your Account. You are solely responsible for safeguarding the confidentiality of your password. As with any password, it must be difficult to guess, and you should change it from time to time.

Using Give for Good. When posting on the Platform, you must post in the appropriate category. When posting or replying to a posting, users agree that they will not:

  • Violate any laws.
  • Lie or be misleading.
  • Infringe any third-party right, including copyright.
  • Distribute or promote spam, chain letters, pyramid schemes, or multi-level marketing programs.
  • Distribute anything that may damage the Platform or harm the interests of the users of the Platform, such as a virus.
  • Use any automated means like a web crawler to access the Platform and collect content and information for any purpose.
  • Collect or distribute information about users of the Platform without their consent.

Privacy and Security. United Way takes privacy very seriously, and our Privacy Policy is applicable to this Platform; please see our Privacy Policy for more information. By accessing the Platform, you consent to the collection, use, and disclosure of your personal information in compliance with our Privacy Policy, for the purposes of administering the Platform and providing services thereon. The security of your personal information is very important to us. We use physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized disclosure. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee its security. Any transmission of personal information is at your own risk.

Content. The Services and Platform contain content from us, you, and other users, as well as third-party service providers. You agree not to copy, modify, or distribute our copyrights or trademarks. When you provide content, such as by making a posting, you are granting us certain rights to that content. If you believe that your rights have been violated, please notify our support team, and we will investigate. We reserve the right to remove content where we suspect a violation of these terms and conditions.

Limitation of Liability, Disclaimer of Warranties and Conditions. The Platform’s content is provided “as is” and “as available” for general information only. United Way disclaims all warranties, express or implied. Users use the Platform at their own risk, and United Way is not liable for any damages arising from such use. We do not guarantee the accuracy, completeness, effectiveness, or availability of any posted goods. We do not guarantee the quality, safety, or legality of what is posted on the Platform. You agree that we are not liable for any loss of any kind arising out of your use of Give for Good, no matter how that loss might occur.

Indemnity. You agree to indemnify, defend, and hold harmless United Way, Agency Partners, and their officials, officers, employees, and authorized representatives from and against any liability, loss, injury (including injuries resulting in death), demand, action, cost, expense, or claim of any kind, including but not limited to lawyer’s fees, relating in any way to your breach of these Terms of Use or your use of the Platform.

Links to Third-Party Web Platforms. Links on the Platform are provided for convenience only. United Way is not responsible for the content, accuracy, or reliability of any linked third-party web Platforms.

Platform Policies, Modification, and Severability. United Way reserves the right to make changes to our Platform, policies, or Terms of Use and provide any additional terms at any time. The changes or additional terms are effective immediately upon their posting on the Platform. Your use of the Platform will be subject to the Terms of Use posted on the Platform at the time of use. In the event any of these conditions should be determined to be invalid, void, or for any reason unenforceable, that condition will be deemed to be severable and will not affect the validity and enforceability of any remaining condition.

Termination. United Way may terminate a user’s access to the Platform for violations of these Terms or other policies.

Geographic Restrictions. The Platform is designed for use within Canada and governed by the laws of Alberta and Canada.

Governing Law and Jurisdiction. Use of the Platform and any disputes arising from it are governed by the laws of Alberta and Canada, subject to the jurisdiction of the courts in Alberta.

Donation and Tool Usage Terms. If you choose to make a donation to United Way, you authorize United Way and its agents to deduct any donation and fees you approve by using the donation tool. In addition to these Terms of Use, some donation tools and other tools are subject to separate additional license terms of use.

Request for Permission or Further Information. Usage of the Platform beyond the scope permitted by these Terms requires express written permission from United Way.

Waiver. Failure or delay by United Way in exercising any right, power, or privilege under these Terms shall not constitute a waiver.
